Welcome to Design Temple®. These Terms of Service govern the relationship between Design Temple® ("we," "us," or "the studio") and any person or company that subscribes to our design services ("you" or "the client"). By subscribing to any of our plans, you confirm that you have read, understood, and agreed to these terms in full. If you have questions before subscribing, book a free 15-minute call and we'll walk you through it.

1. What Design Temple® Is

Design Temple® is a design subscription service. For a flat monthly fee, you get access to a dedicated designer ("Design Artisan", "Design Master") who works on your brand's requests on an ongoing basis. There are no contracts, no agencies, no hidden fees, and no scope creep. You subscribe, you submit requests, you receive designs. That's the model.

We are not a traditional agency, we are a Productized Design Studio. We do not operate on project-based contracts or one-time engagements. The service is entirely subscription-based, which means the terms below apply to your active subscription period from the moment your first payment is processed.

2. The Plans

Design Temple® offers three subscription tiers. All prices are in US dollars and billed monthly.

Starter at $599 per month is intended for solopreneurs and startups. It includes 8 design requests per month, a dedicated Design Artisan, delivery in 2 to 3 business days per request, one active task at a time, coverage for up to 4 brands, all included design types, and source files.

Professional at $999 per month is intended for growing direct-to-consumer brands and startups. It includes unlimited design requests, a devoted Design Artisan, delivery in 2 to 3 business days per request, one active task at a time, coverage for up to 10 brands, all included design types, and source files.

Studio at $1,499 per month is intended for brands with high design volume. It includes unlimited design requests, creative direction by José ("Design Master"), delivery in 2 business days per request, two active tasks at a time, unlimited brand coverage, 1 hour of brand strategy consulting per month, and source files.

Design requests on the Starter plan do not roll over. If you do not use all 8 requests within your billing cycle, unused requests expire at the end of that cycle. There are no credits, extensions, or carry-overs.

3. What We Design

We can design anything that can be clearly articulated or visualized. This includes but is not limited to brand identity, logos, print materials, social media assets, packaging, presentations, infographics, banners, landing page visuals, and multi-page documents.

We do not provide motion graphics, video editing, complex UI/UX design, coding, web development, or any service that requires software development. If you are unsure whether your request falls within our scope, submit it through the portal or book a call before subscribing. Requests that fall outside our scope will be flagged and returned without consuming your request quota.

Complex tasks such as custom illustrations, landing pages, multi-page booklets, and infographic systems may be broken into phases and may require more than 2 to 3 business days. This will be communicated clearly in your Trello board before work begins.

4. Turnaround Times

Our standard delivery window is 2 to 3 business days per request. Business days are Monday through Friday, excluding US federal holidays. Any request submitted after business hours on a Friday, or during a holiday, will begin processing on the next working business day.

Turnaround time starts from the moment a request is confirmed as clear and complete in the Trello board, not from the moment it is submitted. Requests that lack sufficient information, references, or context will be paused and returned to you for clarification. The clock resumes once the required information is received.

Quick revisions on completed tasks are typically delivered within one business day. Complex revisions or changes to the overall concept may be treated as a new request.

Design Temple® observes the following US federal holidays, during which no work is delivered: New Year's Day, Martin Luther King Jr. Day, Presidents' Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. When a holiday falls on a weekend, the studio observes the nearest weekday.

5. How Revisions Work

Revisions are unlimited. We will keep working on a design until you are satisfied. To request a revision, use the comment tool in your Figma file or Trello board to mark your feedback directly on the design. This eliminates the need for screenshots, email threads, or lengthy written descriptions.

A revision is defined as a change or correction to a delivered design based on the original brief. If the direction of the project changes significantly after delivery, that may constitute a new request rather than a revision. We will flag this clearly and discuss it with you before proceeding.

6. How to Use the Service

Step 1. Subscribe. Choose the plan that fits your needs and complete the checkout process. You will receive immediate access to your client portal. There are no kickoff calls, no onboarding sessions, and no waiting period. You can start the same day.

Step 2. Access your Trello board. Once subscribed, you will receive an invitation to your dedicated Trello board. This is where all communication, requests, deliveries, and revisions happen. Invite up to two (2) team members so they can submit requests, review work, leave comments, and download files directly.

Step 3. Submit a request. Create a new card in the "Backlog / To Do" column of your board. Write a clear description of what you need, the format, the dimensions, the intended use, and any references or brand guidelines that apply. The more context you provide, the faster and more accurately we can deliver. Attach any files, logos, or inspiration that will help our designer understand your vision.

Step 4. We get to work. Our designer picks up your request and begins working. You will see the card move through the board stages so you always know where your project stands. We work on one task at a time on the Starter and Professional plans, and two tasks at a time on the Studio plan.

Step 5. Receive your design. Delivered files will be attached directly to your Trello card. You will receive final files in the formats relevant to your request, including print-ready PDFs, web-optimized PNGs, and source files in compatible formats. We do not deliver files in Figma or Adobe-native formats.

Step 6. Request revisions if needed. If anything needs to be adjusted, use the comment tool to mark your feedback directly on the design. Be specific. The more precise your feedback, the faster we can turn it around. Revisions are unlimited.

Step 7. Approve and archive. Once you are happy with the result, mark the card as approved and move it to the "Approved / Delivered" column. Your files are stored in the board and you can download them at any time during your active subscription.

7. File Delivery and Storage

Final files are delivered through Trello and include formats appropriate to the project type, such as PDF, PNG, SVG, Affinity, and other industry-standard formats compatible with common design and production tools. Source files are included in all plans.

Design Temple® is not responsible for storing your files indefinitely. We recommend downloading and backing up all delivered files to your own systems. We cannot guarantee file recovery after a subscription is over or cancelled.

8. Billing, Pausing, and Cancellation

All plans are billed monthly on a recurring basis. Your subscription renews automatically on the same date each month unless you cancel or pause it.

You may pause or cancel your subscription at any time, with no notice period required and no cancellation fee. If you cancel, your subscription remains active until the end of the current billing period. No partial refunds are issued for unused days within a paid cycle.

Design Temple® offers a 7-day money-back guarantee on your first payment only. If you are not satisfied within the first 7 days of your initial subscription, contact us and we will issue a full refund, no questions asked. This guarantee does not apply to subsequent billing cycles or plan changes.

Upgrading or downgrading between plans takes effect at the start of the next billing cycle unless otherwise arranged.

9. Refunds

Outside of the 7-day initial guarantee described above, refund requests are evaluated on a case-by-case basis. Design Temple® is not obligated to issue refunds but will review all requests in good faith. If a refund is approved, all design work produced during that billing period becomes the sole property of Design Temple® and may not be used by the client in any form. Non-refundable payment processing fees are excluded from any refund issued.

Design Temple® reserves the right to terminate a subscription and issue a full or partial refund at its own discretion if it determines it cannot adequately service a client's needs.

10. Intellectual Property and Ownership

Upon full payment for the applicable subscription period, the client owns full intellectual property rights to all original designs created and delivered by Design Temple® during that period. You are free to use, modify, reproduce, and commercialize the work as you see fit.

In the event that any applicable law would otherwise cause ownership to revert to Design Temple®, we irrevocably and permanently assign all rights in full to the client, without limitation.

Design Temple® retains no licensing rights over the delivered work beyond the portfolio display right described in Section 11.

11. Portfolio and Public Display

Design Temple® reserves the right to display completed work publicly, including on our website, Behance profile, and social media channels, for promotional purposes. This applies to all projects regardless of their nature.

Design Temple® does not sign non-disclosure agreements. If a project is confidential or commercially sensitive, you acknowledge by subscribing that Design Temple® may still use the delivered work in its communications. If this is a concern, please do not subscribe.

12. Third-Party Assets and Licensing

Design Temple® may incorporate third-party fonts, stock imagery, or other licensed assets into your work. When this happens, we will inform you in writing and specify which licenses you need to obtain independently in order to legally reproduce, distribute, or publish the work commercially. Design Temple's licenses for third-party assets are not transferable to the client unless explicitly confirmed in writing.

The client assumes full responsibility for any unauthorized use of licensed materials once the work has been delivered. It is the client's responsibility to ensure that all assets they provide to Design Temple® are owned by them or are properly licensed for the intended use. Design Temple® accepts no liability for claims arising from client-provided materials.

13. Acceptable Use

By subscribing, you agree not to use Design Temple's services to create content that is illegal, discriminatory, defamatory, or in violation of any third party's rights. You further agree not to misrepresent your identity or the nature of your business, attempt to circumvent or manipulate the service model, or use the service in a manner inconsistent with any applicable laws or regulations.

Design Temple® reserves the right to decline any request it deems unethical, harmful, or outside the values of the studio, at its sole discretion and without liability. Design Temple® also reserves the right to terminate a subscription immediately and without refund if a client is found to be in material breach of this section.

14. What We Don't Do

Design Temple® does not attend external meetings, presentation calls, or live working sessions as part of any plan. All communication happens through Trello. This is by design, not by accident. It keeps the process fast and focused.

We do not provide legal review of designs, trademark clearance, print production management, or vendor coordination. Any designs intended for trademark registration should be reviewed by a qualified intellectual property attorney before filing.

We do not guarantee that any design will meet specific legal, regulatory, or platform-specific requirements. The client is responsible for verifying that delivered designs comply with all applicable laws, platform guidelines, and industry standards before use.

15. Electronic Communications

By subscribing, you consent to receive communications from Design Temple® electronically, including through your Trello board and by email. You agree that all notices, disclosures, and other communications sent electronically satisfy any legal requirement that such communication be made in writing. You also agree to the use of electronic records and delivery of notices and policies through electronic means.

16. Limitation of Liability

Design Temple's total liability to the client for any claim arising from or related to the service is limited to the amount paid by the client in the month in which the claim arises. We are not liable for indirect, incidental, special, or consequential damages of any kind, including lost revenue, lost business opportunities, or reputational damage resulting from the use or inability to use our designs or service.

Design Temple® makes no warranties, express or implied, beyond those explicitly stated in these terms. We do not guarantee that designs will be approved by third-party platforms, print vendors, or regulatory bodies. The service is provided as-is. Design Temple® is a design execution service, not a strategic consultancy, unless explicitly contracted as such.

17. Indemnification

The client agrees to defend, indemnify, and hold harmless Design Temple® and its team members from and against any loss, damage, liability, claim, or demand — including reasonable legal fees — arising out of the client's use of the service, breach of these terms, violation of any third party's rights, or use of client-provided materials that infringe on intellectual property or other rights.

18. Changes to These Terms

Design Temple® reserves the right to update these terms at any time. When we do, we will update the effective date at the top of this page. If changes are material, we will notify active subscribers by email with reasonable advance notice. Continued use of the service after the effective date of any update constitutes acceptance of the revised terms.

19. Governing Law

These terms are governed by and construed in accordance with the laws of Chile. Any dispute arising from this agreement that cannot be resolved between the parties directly shall be subject to the exclusive jurisdiction of the courts of Santiago, Chile.

20. Miscellaneous

These terms, together with any policies published on our website, constitute the entire agreement between Design Temple® and the client. If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining terms will continue in full force and effect. Failure by Design Temple® to enforce any right or provision does not constitute a waiver of that right. Nothing in these terms creates a partnership, employment relationship, joint venture, or agency between the client and Design Temple®.
